Overview
The Intellectual Property Law Section of the State Bar of California is pleased to present an afternoon meeting with James Dwyer, Deputy Commissioner for Patent Operations, and Janet Gongola, Patent Reform Coordinator. The USPTO officials will provide an update on new policies and procedures that will assist the practitioner in preparing for the March 16, 2013 critical date in complying with the America Invents Act (AIA), including considerations for filing utility and continuation in part patent applications prior to the critical date. The PTO is reaching out to the community to explain the impact of these changes and to hear from the patent community. Mr. Dwyer and Ms. Gongola will hold an open forum and take your questions and comments regarding ways to improve the patent system, work with the changes, and promote innovation.
Program Abstract
Deputy Commissioner Dwyer and Ms. Gongola will address the PTO’s implementation of AIA and initiatives for improving the patent process. They will discuss how to increase patent quality and decrease pendency through changes to the Examiner incentives, compact prosecution, accelerated examination, and increased use of interviews. They will also address concerns of patent practitioners, including improving communication and increasing transparency. Other initiatives to be discussed will include the e-petitions program, improving IT infrastructure, the new fee structure, and proposed rules for implementing various provisions of the AIA including third party preissuance submissions, supplemental examination, post grant review, and inter partes review.
